Conditions for the Use of the Trademark of the Registrar and the Use of the Accreditation Marks

1. Foreword

This appendix deals with the proper use of the trademark of TUV Rheinland of North America, Inc.(hereinafter referred to as TUV Rheinland) and the use of the accreditation marks by a registered company. Publicizing registration to one of the ISO conformance standards is the right and option of each company gaining registration (herein referred to as certificate holder).

Registration indicates conformance to the standards for documented management systems and the effective implementation of such systems. It does not indicate an endorsement or approval by the International Organization for Standardization, or a product certification of any kind. ISO develops international standards but does not operate a scheme for verifying conformance to them. Using the logo in advertisements would give the impression that ISO has "approved" such registration or even carried it out. Therefore, it is incorrect for the certificate holder to describe the company as "ISO registered" or "ISO certified". In fact, the Registrar, not the International Organization for Standardization, is the body giving its word that the management system which has been certified conforms to the applicable ISO standard(s). The Accreditation Bodies stand behind TUV Rheinland to ensure that its qualifications, business practices and methods are proper and effective.

A certificate holder may use the Trademarks specified hereafter in the forms and layout as shown in the enclosure on page 7.

2. Conditions for the Use of the Trade Mark of

TUV Rheinland of North America, Inc.

2.1. The principle regarding the use of the trade mark of TUV Rheinland for advertising compliance to a particular ISO standard is to avoid using false, misleading, or confusing claims to the public and customers.

2.2. The trade mark of TUV Rheinland of North America, Inc. may be used in the following representational form:

The "Triangle" is a registered trademark (No. 1,674,458) with the United States Patent and Trademark Office.

2.3. The trademark shall be reproduced:

* either in the color blue as specified in Graphic Code PMS 300,
* or black, or in the predominant color of the letterhead or printing
* on a clearly contrasting background
* in a size which makes all features of the mark clearly distinguishable, the length of a side of the triangle being no less than 12.7 mm (1/2 inch)

2.4. The trademark may be used only in the form shown in item 2.2. above. Additional information, e.g. Certificate Number or applicable standard is permitted in conjunction with the trademark. The trademark must be fully legible and clearly visible.

2.5. Neither the name "ISO", nor the ISO logo may be used in conjunction with any material publicizing the ISO registration.

2.6. For multi-site companies, the trademark must only be used in conjunction with the company's name and location that gained registration.

2.7. For a certificate holder that gained registration for only a portion of their manufacturing processes or services claims to registration must be specific and not provide the impression of "company wide" registration.

2.8. The trademark may not be used for the labeling of individual products, or in intimate association with the products in a manner which suggests that the products themselves are TUV Rheinland certified.

2.9. If an indication regarding the Standard is used, the certificate holder may not use the generic term ISO 9000 or ISO 14000. The certificate holder must indicate the ISO Standard for which their registration applies (ISO 9001, ISO 9002, ISO 9003, ISO 14001).

2.10. The certificate holder ensures that the use of the trademark in advertising or for other measures takes place within these conditions. The certificate holder is responsible to TUV Rheinland for the use of the trademark, in particular also in an advertising context. In cases of doubt, the certificate holder shall contact TUV Rheinland for clarification of any issues relating to the use of the trademark.

2.11. If necessary, other requirements with regard to the use of marks will be developed in consultation with individual certificate holders and TUV Rheinland. Such requirements will be part of the certification agreement and the client will immediately be subject to such requirements.

3. Conditions for the Use of the Accreditation Marks

Each Accreditation Body grants TUV Rheinland the right to apply the Accreditation Body mark on all documents which relate to the accredited registration system, subject to certain rules and regulations. The documents include certificates, stationery, and literature associated with the Registrars accredited registration activities. The Accreditation Bodies have provided written rules to TUV Rheinland which include requirements for color, size, and location of the trademark.

3.1. Note: The following regulations apply only to certificate holders who have received a registration certificate from TUV Rheinland of North America, Inc. with an accreditation mark from the Dutch Council for Accreditation (RvA).

3.1.1. The RvA accreditation mark may be used in the following representational form;

The mark is registered under no. 151810 with the Benelux Mark Register.

3.1.2. Appliance of the accreditation mark is permitted:

* either in the color orange, as specified in Graphic Code PMS 021;
* or in the color with which the letter paper is printed;
* or in black on a white background, or a background in another color clearly contrasting with black;
* or in white on a black background;
* with a diameter of at least 5 mm.

3.1.3. The size of the accreditation mark must not exceed the size of the registration mark of TUV Rheinland.

3.1.4. The certificate holder may use the RvA accreditation mark only in conjunction with the registration mark of TUV Rheinland on his stationary and literature, subject to these conditions and to the conditions for use of the registration mark of TUV Rheinland given in item 2.2.

3.1.5. Neither the mark of TUV Rheinland nor the RvA accreditation mark shall be used on a product or in such a way as to suggest that the registrar and/or the RvA have certified or approved any product, process or service of a registered supplier, or in any other misleading manner.

3.1.6. If necessary other regulations will be laid down in writing with regard to the use of the marks in consultation with the certificate holder, the registrar and the accreditation body. Such a regulation shall be a part of the certification agreement.

3.2. Note: The following conditions apply only to clients who have received a registration certificate from TUV Rheinland of North America, Inc. with an accreditation mark from ANSI-RAB, the joint program of the American National Standard Institute and the Registrar Accreditation Board for the accreditation of quality system registrars.

3.2.1. The ANSI-RAB accreditation mark may be used in the following representational form:

3.2.2. The ANSI-RAB accreditation mark shall be reproduced:

* in black, or in gold, or in the predominant color of the letterhead or printing;
* on a clearly contrasting background;
* in a size which makes all features of the mark clearly distinguishable, the length of the side of the triangle being in no case less than 10 mm.

3.2.3. The size of the accreditation mark must not exceed the size of the registration mark of TUV Rheinland.

3.2.4. The certificate holder may use the ANSI-RAB accreditation mark only in conjunction with the registration mark of TUV Rheinland on his stationary and literature, subject to these conditions and to the conditions for use of the registration mark of TUV Rheinland given in item 2.2.

3.2.5. Neither the mark of TUV Rheinland nor the ANSI-RAB accreditation mark shall be used on a product or in such a way as to suggest that the registrar and/or the RAB and/or ANSI have certified or approved any product, process, or service of a registered supplier, or in any misleading manner.

3.2.6. If necessary other regulations will be laid down in writing with regard to the use of the marks in consultation with the certificate holder, the registrar, and the accreditation body. Such a regulation shall be part of the certification agreement.

3.2.7 TUV Rheinland will not use the ANSI-RAB accreditation in such a manner as to bring ANSI or RAB into disrepute and shall not make any statement regarding its accreditation which either ANSI or RAB may consider misleading or unauthorized.

3.2.8 Upon suspension or withdrawal of ANSI-RAB accreditation, TUV Rheinland will discontinue its use of all advertising matter that contains any reference thereto and return any accreditation documents as required by ANSI-RAB.
